SimPath Academy (“SimPath Academy,” “we,” “us,” or “our”) operates the certification-preparation platform available at simpathacademy.com (the “Service”). We provide exam-preparation courses and learning tools to learners at all levels. We take the privacy of every learner seriously, and we are committed to protecting the personal information of everyone who uses the Service.

This Privacy Policy explains what information we collect, how we use and protect it, and the rights and choices available to you. It also describes how we comply with the Children’s Online Privacy Protection Act (COPPA), the Children’s Internet Protection Act (CIPA), the Florida Information Protection Act, and other applicable United States and Florida laws.

1. Who This Policy Applies To

This Policy applies to all visitors and users of the Service, including learners of all ages and the parents or legal guardians of learners who are minors. The Service is currently offered to users in the United States and Canada.

2. Information We Collect

We practice data minimization: we collect only the information reasonably necessary to provide and improve the Service. We collect the following categories of information:

  • Account information. Name, email address, and a securely hashed password.
  • Learning and progress data. Courses and lessons accessed, quiz and assessment responses, scores, completion status, and similar records generated as a learner uses the Service.
  • Technical and log data. IP address, browser type, device information, and access timestamps, used to operate, secure, and troubleshoot the Service.
  • Communications. Messages you send to us, such as support requests.

We do not collect more personal information from any learner, and in particular from a child, than is reasonably necessary to participate in the educational activity, and we do not require anyone to disclose more information than is needed to use the Service.

3. How We Use Information

We use personal information only for legitimate educational and operational purposes, including to:

  • provide, maintain, and personalize the learning experience;
  • track and report learning progress and assessment results;
  • create and manage accounts and authenticate users;
  • communicate about accounts, courses, and support;
  • secure the Service and prevent fraud or abuse; and
  • comply with our legal obligations.

Assessment scoring and progression on the Service are fully deterministic and rule-based; there is no automated decision-making or artificial intelligence in the pass, fail, or progression path. Where any learner-facing content has been generated or assisted by artificial intelligence, it is labeled as such.

We do not use personal information, and we never use the personal information of children, to engage in targeted advertising, to build advertising or marketing profiles, or for any commercial purpose unrelated to the educational service.

4. Children’s Privacy and COPPA Compliance

We are committed to compliance with the Children’s Online Privacy Protection Act (COPPA) and its implementing regulations. We do not knowingly collect personal information from a child under 13 without first obtaining verifiable parental consent.

  • We collect from children only the information needed to participate in the educational activity.
  • We do not condition a child’s participation on disclosing more information than is reasonably necessary.
  • We do not sell children’s personal information, and we do not use it for behavioral advertising or profiling.
  • We retain children’s personal information only as long as necessary to provide the Service and delete it when it is no longer needed for that purpose.

Parental rights. A parent or legal guardian may review the personal information we have collected about their child, request that we correct or delete it, and refuse to permit further collection or use of the child’s information. To exercise these rights, contact us at the address in Section 10. We will verify the identity of anyone making such a request before acting on it.

5. Age-Appropriate Content

Our courses and learning materials are curated to be appropriate for learners of all ages. Consistent with the principles of the Children’s Internet Protection Act (CIPA), the Service does not present obscene content or content that is harmful to minors, and it contains no advertising networks or third-party content feeds.

6. Compliance With Florida and United States Law

We comply with applicable United States and Florida privacy and data-security laws. In the event of a breach of security affecting personal information, we will notify affected individuals and, where required, the Florida Department of Legal Affairs, in accordance with the Florida Information Protection Act (section 501.171, Florida Statutes), without unreasonable delay and within the timeframes the law requires. We also honor the data-privacy rights of users who reside in other states, to the extent those laws apply.

7. How We Share Information

We do not sell personal information, and we do not rent or trade it. We share information only in these limited circumstances:

  • Service providers. Trusted vendors that host our infrastructure and deliver email on our behalf, bound by contract to protect the information and use it only to provide services to us.
  • Legal requirements. When required by law, subpoena, or other legal process, or to protect the rights, safety, and security of our users and the Service.
  • Business transfers. In connection with a merger, acquisition, or sale of assets, in which case we will require the successor to honor the commitments in this Policy and will notify affected users.

8. Data Security

We protect personal information with administrative, technical, and physical safeguards appropriate to its sensitivity. These include encryption of data in transit, secure hashing of passwords, role-based access controls that limit access to authorized personnel, and ongoing monitoring of our systems. No method of transmission or storage is completely secure, but we work continually to protect the information entrusted to us.

9. Data Retention and Deletion

We retain personal information for as long as an account is active or as needed to provide the Service, and thereafter only as required to comply with our legal obligations, resolve disputes, and enforce our agreements. Parents may request deletion of a child’s information as described above, and any user may request deletion of their account information. We delete or de-identify personal information when it is no longer needed for these purposes.

Subject to applicable law, you may request to access, correct, or delete your personal information, and you may opt out of non-essential communications at any time. Parents may exercise these rights on behalf of their children.

11. Cookies and Tracking

We use only essential cookies needed to keep you signed in and to protect the security of your session. We do not use third-party advertising cookies or cross-site tracking technologies on the Service.

12. Changes to This Policy

We may update this Policy from time to time. When we make material changes, we will revise the “Last updated” date above and, where the change materially affects how we handle children’s information, provide notice to affected parents or users. Your continued use of the Service after an update takes effect constitutes acceptance of the revised Policy.
